TERMS & CONDITIONS YAMAHA RACING EXPERIENCE

The following Terms & Conditions apply:

Yamaha Motor Europe N.V., its branch offices and related affiliates (jointly and separately referred to as "Yamaha Motor Europe") unless otherwise referenced herein, any reference to Yamaha Motor Europe shall include all of its branch offices and related affiliates, invites every Model Year 2022 YZF-R1M owners and every Model Year 2021 YZF-R1M owner bought after closing date of registration for the 2021 Yamaha Racing Experience (August 1st 2021) to join a Yamaha Racing Experience event in summer of 2022 on one of the major European tracks selected by Yamaha Motor Europe, subject to the Yamaha Racing Experience capacity.

You will need to indicate your interest in attending a Yamaha Racing Experience event online and you can do so in your online registration when registering for the purchase of the YZF-R1M (hereafter referred to as “R1M”). If you indicated your interest for the Yamaha Racing Experience, Yamaha Motor Europe will send you, within three (3) working days after the conclusion of your purchase contract, an email with your personal login data for the Yamaha Racing Experience website.

You will need to apply for the Yamaha Racing Experience via the Yamaha Racing Experience website. Upon your registration you will receive an acknowledgement of receipt of your application by email. Received applications for the Yamaha Racing Experience will be confirmed within five (5) working days counting from the day the acknowledgement of receipt email was sent.

Yamaha Motor Europe will not be responsible for the organization of the Yamaha Racing Experience. An external agency (“the Agency”) has been contracted by Yamaha Motor Europe to organize the Yamaha Racing Experience.

The Agency which has been contracted by Yamaha Motor Europe to facilitate the Yamaha Racing Experience will contact you by phone or email to arrange further details for the event. In this role the Agency will process your personal data on behalf of Yamaha Motor Europe. Yamaha Motor Europe is not a party to your contract with the Agency. In relation to the processing of personal data, the Agency will act on its own behalf as data controller under the applicable data protection laws.
Your participation will be secured only after you have confirmed your attendance to the Yamaha Racing Experience in writing to the Agency and the Agency has confirmed your attendance to Yamaha Motor Europe.

The Yamaha Racing experience consists of:

  • One day riding with Yamaha Racing professionals, on a major European circuit selected by Yamaha Motor Europe N.V.
  • Professionals available to give you advice on setting up your R1M
  • Riding instructions
  • Catering

When registering to the event you will also have the option to select an hotel stay for the night before the day at the circuit, which will include a dinner covered and organised by Yamaha Motor Europe for R1M owners. The journey to and from the race track (including any travel expenses to the country where the track is situated), your own R1M in full riding condition, appropriate racing riding gear, insurance, physical and mental fitness and a good spirit will all be your own responsibility and will be at your own expense.

You may only participate if you are over eighteen (18) years of age and in the possession of a valid motorcycle driving license for the R1M.

You should arrange for the appropriate insurance of yourself and the R1M, bearing in mind that racing may be defined as a 'dangerous sport' by insurers.

If Yamaha Motor Europe (or the Agency on our behalf) rules at any time at its own discretion that your R1M and/or you yourself are not fit or pose a risk (to yourself or others) when riding on the circuit, we reserve the right to refuse or to terminate your participation before or during the event.

Your invitation to the Yamaha Racing Experience is personal and cannot be transferred to another person.

Cancellation

Should you need to cancel your participation to the Yamaha Racing Experience, please notify the Agency without undue delay by email. Contact details for such cancellation will be included in the correspondence of the Agency. In case of a cancellation at least seven (7) days prior to the event, no charges will occur. In case you do not cancel your attendance at least seven (7) days prior to the event, and do not attend the event, Yamaha Motor Europe shall not be obliged to provide any compensation and shall not be liable for any costs or damages, including but not limited to cancellation fees and travel expenses. Yamaha Motor Europe will also not be liable if the Yamaha Racing Experience is delayed or cancelled for any reason or if your participation is rescheduled, cancelled or refused. In any event, Yamaha Motor Europe shall not be obliged to provide any compensation, including but not limited to compensation linked to your own expenses.

Liability
Your participation to the Yamaha Racing Experience is at your own risk. In participating and/or attending the Yamaha Racing Experience you may be exposed to possible risk of physical harm due to its nature. Yamaha Motor Europe will not be liable for any loss, injury or damage, however caused, to you or your properties except where and only to the extent that any such is caused by willful intent or gross negligence of Yamaha Motor Europe. Without prejudice to the foregoing, Yamaha Motor Europe excludes to the maximum extent permitted by law any liability for such losses.

General
Yamaha Motor Europe may at any time revise these Terms and Conditions.

These Terms and Conditions are exclusively governed by Dutch law. Any disputes arising from these Terms and Conditions for Customers will be exclusively submitted to the competent court in Amsterdam, The Netherlands.
